Circles Terms of Service

Welcome to Circles.

These Terms of Service (“Terms”) govern your use of the Circles website, mobile applications, and related services (collectively referred to as the “Service”).

By creating an account or using Circles, you agree to be legally bound by these Terms. If you do not agree, you must not use the Service.

These Terms form a legally binding agreement between you (“Member”, “you”, “your”) and Circles (“we”, “our”, “us”).

Circles is an online community designed for adults seeking casual social and sexual connections, be that occasional, regular, swinging or kinks.

Our aim is to create an environment where members feel safe, respected and able to communicate openly.

Circles facilitates introductions between members. We do not guarantee compatibility, responses, relationships or meetings.

You may only use Circles if you:

• are at least 18 years old;
• provide ID verification;
• have the legal capacity to enter into contracts;
• provide accurate registration information;
• comply with these Terms and all applicable laws.

Creating an account on behalf of another person is prohibited unless expressly authorised by us.

Circles operates an identity verification programme designed to improve member safety.

You will be required to verify your identity before accessing certain features.

Verification requirements, accepted documentation and processing methods are described in our Age Verification Policy.

Providing false or fraudulent identification may result in immediate account suspension or permanent removal.

You are responsible for:

• maintaining the confidentiality of your login credentials;
• all activity conducted using your account;
• keeping your information accurate and up to date.

You must notify us immediately if you believe your account has been compromised.

Some areas of Circles requires a paid membership.

Membership fees, renewal periods and cancellation procedures are all displayed before purchase.

Unless stated otherwise:

• Subscriptions automatically renew;
• You may cancel renewal at any time;
• Cancellation prevents future billing but does not refund the current billing period.
• There are no refunds under any circumstances.

Consumer cancellation rights remain unaffected where required by law.

Members agree to behave respectfully towards others, both in person and online.

You must not:

• Harass, threaten or intimidate others;
• Discriminate against other members;
• Impersonate another person;
• Create fake accounts;
• Share another person’s private information;
• Upload illegal content;
• Upload content involving anyone under 18 years of age;
• Use Circles for fraud or criminal activity;
• Attempt to interfere with the security or operation of the Service.

You retain ownership of content that you upload.

By submitting content to Circles you grant us a non-exclusive, worldwide licence to:

• host;
• store;
• display;
• reproduce;
• process;

your content solely for the operation, security and promotion of the Service.

You confirm at the time of upload that:

• You own the content or have permission to use it;
• The content does not infringe another person’s rights;
• The content complies with these Terms.

The following content is prohibited:

• images or videos depicting anyone under 18;
• illegal material;
• non-consensual intimate imagery;
• copyrighted material uploaded without permission;
• content encouraging violence;
• terrorist or extremist content;
• scams or deceptive advertising;
• malware or harmful software.

We WILL remove prohibited content without notice and contact law enforcement if we deem it necessary.

Members may report:

• Abusive behaviour;
• Fake profiles;
• Harassment;
• Inappropriate images;
• Illegal content;
• Safety concerns.

Reports are reviewed by our moderation team.

False or malicious reports may themselves breach these Terms of Use.

Circles may investigate suspected breaches of these Terms.

We may:

• remove content;
• restrict features;
• suspend accounts;
• permanently terminate accounts.

Moderation decisions may be appealed through our Complaints and Appeals Policy.

Meeting another member is entirely your own decision.

Circles cannot guarantee:

• another member’s behaviour;
• compatibility;
• honesty;
• personal safety during offline meetings.

Members should exercise good judgement and follow our Safety Guidance.

The Circles name, branding, logos, software and original content remain the property of Circles unless otherwise stated.

You may not copy, reproduce or redistribute our intellectual property without written permission.

Our collection and processing of personal information is explained within our Privacy Policy.

By using Circles you acknowledge that your information will be processed in accordance with that policy.

Circles uses cookies and similar technologies as described in our Cookie Policy.

We aim to provide a reliable service but cannot guarantee uninterrupted availability.

Maintenance, upgrades or technical issues may occasionally affect access.

We may:

• introduce new features;
• remove existing features;
• improve security;
• modify functionality.

Where appropriate, we will provide reasonable notice of significant changes.

We may suspend or terminate your account where:

• these Terms are breached;
• illegal activity is suspected;
• required by law;
• necessary to protect other members or the Service.

Termination does not remove obligations that arose before termination.

Nothing in these Terms limits liability where such limitation would be unlawful.

To the fullest extent permitted by law, Circles shall not be liable for indirect or consequential losses arising from your use of the Service.

Nothing in these Terms affects your statutory rights under UK consumer law.

We may update these Terms from time to time.

Where changes materially affect your rights or obligations, we will provide appropriate notice.

Continued use of Circles after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales unless applicable consumer law provides otherwise.
